I want to terminate S.P.A. on account of delays in handover of the property

We review the S.P.A. If it stipulates the date of handover and the extension period. If there was no notice issued to confirm further extension of handover rate. You have the right to request the Court to terminate the S.P.A. and ask for full refund and compensation thereof. We can confirm the above only after complete review of your file.

Scenario 2

There is a difference in size of the property purchased, can I terminate the SPA and get refund?

If the value paid is in accordance to the sq feet mentioned in the signed S.P.A. and if on handover there is a difference more than 6%, and that difference is authenticated by the court-appointed technical Expert, you have the right to request the court to terminate the S.P.A. and get a full refund and of course claim compensation.

Scenario 3

If property is purchased as hotel apartment and on handover it is residental apartment, in such cases can the S.P.A. be terminated?

If the S.P.A. clearly states that its a hotel apartment and both parties have signed the agreement and there is no addendum signed by both parties agreeing otherwise, it is possible to request the court to terminate the S.P.A. and get full refund. Also it is possible to claim compensation thereof.

If there is a change in the branding of the property can the S.P.A. be terminated?

If the S.P.A. clearly mentions the brand name of the property and at the time of signing the S.P.A. that was a famous brand name. Upon handover, if the brand name is changed, we can put forth a request to request to the Court to terminate the S.P.A. and ask full refund. Compensation can be claimed as well.
