Amended Provisions under Federal Decree-Law No. (9) of 2024 Regarding Labor Relations

In line with the ongoing efforts of the legislator to enhance and develop legislation, Federal Decree-Law No. (9) of 2024 was issued, which introduced amendments to Federal Decree-Law No. (33) of 2021 concerning the regulation of labor relations. This decree aimed to amend Articles 54 and 60.

It is worth noting that Article 54 of Decree No. 33 of 2021 had previously undergone amendments under Decree No. 20 of 2024. These amendments reflect the legislator’s commitment to achieve a balance between conflicting interests and updating legislation in line with current changes, thereby directly impacting the relationship between workers and employers.

Given the significance and importance of these amendments, we will highlight in this article the amendments made to Article 54 of Federal Decree-Law No. 33 of 2021. We will dedicate the following article to discussing the amendments to Article 60.

Article 54 outlines the procedures for individual labor disputes before the Ministry of Human Resources and Emiratization and labor courts. While Decree No. 9 maintained part of the procedures as they were, it introduced several critical amendments, as follows:

First Point: Jurisdiction of the court in hearing the labor case after the decision is issued by the Ministry.

The new decree stipulates that the primary court is competent to hear this case, abolishing the previous Decree No. 20, which had determined that the appellate court was the competent court for hearing such cases.

Second Point: The period during which the labor case shall be filed, and the start date of this period.

The new decree determined that the period during which the labor case shall be filed is two years from the date of the termination of the employment relationship. This amends the period during which the case could be filed, which was previously one year from the date of entitlement to the labor claim.

Important Note: It is noteworthy that the new decree specifies that the start of the two years is from the termination of the labor relationship, not from the entitlement to the claim, as stated in Decree No. 20 of 2024.

Third Point: Amendment of the nature of the decision issued by the Ministry of Human Resources and Emiratization in the labor complaint.

While Decree No. 20 of 2024 described the decision issued by the Ministry as a “final decision in the dispute,” the new decree only refers to the decision as a “decision”.

Fourth Point: Amendment of the period allocated for adjudicating the case before the court.

The new decree amended the period allocated for adjudicating the case by the competent court to 30 days instead of 15 days, as was stated in Decree No. 20 of 2024.

These amendments illustrate the ongoing efforts to develop and improve the legal procedures related to labor disputes while preserving the rights of all concerned parties.

في إطار جهود المشرع المستمرة لتعزيز وتطوير التشريعات، صدر المرسوم بقانون اتحادي رقم (9) لسنة 2024، الذي أجرى تعديلات على المرسوم بقانون اتحادي رقم (33) لسنة 2021 والمتعلق بتنظيم علاقات العمل. استهدف هذا المرسوم تعديل المادتين 54 و60، مع الإشارة إلى أن المادة 54 قد خضعت لتعديل سابق بموجب المرسوم رقم 20 لDسنة 2024. تعكس هذه التعديلات حرص المشرع على تحقيق توازن بين المصالح المتعارضة وتحديث التشريعات بما يتماشى مع المتغيرات الحالية، مما يؤثر بشكل مباشر على العلاقة بين العمال وأصحاب العمل.

ونظرا لخطورة وأهمية هذه التعديلات، سأسلط الضوء في هذه المقالة على التعديلات التي وردت على المادة 54 من ، المرسوم بقانون اتحادي رقم 33 لسنة 2021.  وسافرد المقالة التالية للحديث عن التعديلات عن المادة 60

توضح المادة 54 والتعديلات التي طرأت عليها جميع جوانب المنازعات العمالية الفردية، كما تحدد طريقة معالجتها من قبل وزارة الموارد البشرية والتوطين والمحكمة العمالية. وعلى الرغم من أن المرسوم رقم 9 حافظ على معظم الإجراءات كما هي، إلا أنه أدخل تعديلات هامة جداً:

النقطة الأولى: اختصاص المحكمة في النظر بالدعوى العمالية بعد صدور القرار المنهي للخصومة من الوزارة

   قرر المرسوم الجديد أن المحكمة الابتدائية هي المختصة بالنظر في هذه الدعوى، وألغى العمل بالمرسوم السابق رقم 20 والذي كان قد قرر أن المحكمة الاستئنافية هي المختصة بنظر تلك الدعوى.

النقطة الثانية: فترة السماح بتسجيل الدعوى العمالية

   قرر المرسوم الجديد أن المدة المسموح خلالها تقديم الدعوى العمالية هي سنتين من تاريخ انتهاء علاقة العمل،    وبهذا يكون المرسوم الجديد قد ألغى العمل بالمرسوم السابق رقم 20 والذي كان قد قرر أن المدة التي تسمع خلالها الدعوى هي سنة من تاريخ انتهاء العلاقة العمالية.

ملاحظة مهمة: ومن اللافت للذكر أن المرسوم الجديد قد حدد بداية السنتين هي انتهاء العلاقة العمالية وليس استحقاق الحق محل المطالبة  كما ورد في المرسوم رقم 20 لسنة 2024

النقطة الثالثة: تعديل صفة القرار الصادر عن وزارة الموارد البشرية والتوطين في الشكوى العمالية

   في حين كان المرسوم رقم 20 لسنة 2024 يصف القرار الصادر عن الوزارة بأنه “قرار منهي للخصومة”، فإن المرسوم الجديد اكتفى بالإشارة إلى القرار بعبارة “قرار” دون تحديد صفة معينة.

النقطة الرابعة: تعديل المدة المحددة للفصل في الدعوى أمام المحكمة الابتدائية

   عدل المرسوم الجديد المدة المحددة للفصل في الدعوى من قبل المحكمة المختصة لتصبح 30 يوماً بدلاً من 15 يوماً كما كانت قد وردت في المرسوم رقم 20 لسنة 2024.

توضح هذه التعديلات الجهود المستمرة لتطوير وتحسين الإجراءات القانونية المتعلقة بالمنازعات العمالية، مع الحفاظ على حقوق جميع الأطراف المعنية.

مع اقتراب بداية العام الدراسي الجديد، وتحديدًا في26 أغسطس 2024، تطلق وزارة الداخلية في دولة الإمارات العربية المتحدة حملة بعنوان “يوم بلا حوادث”. تستمر هذه الحملة ليوم واحد فقط، ,ويتم خصم عدد من النقاط المرورية للملتزمين بالقوانين. تأتي هذه الحملة في إطار حرص الوزارة على ضمان سلامة الطلاب والمواطنين على الطرقات، وخلق بيئة آمنة تعزز من ثقافة القيادة الآمنة.

خصم نقاط مرورية

تتميز هذه الحملة بتقديم خصم قدره 4 نقاط مرورية للسائقين الملتزمين خلال هذا اليوم، وذلك كمكافأة لهم على حرصهم على السلامة العامة والالتزام بالقوانين. يعكس هذا الإجراء التزام وزارة الداخلية بتشجيع السائقين على تحسين سلوكهم المروري وتبني أساليب قيادة أكثر أمانًا.

الإطار القانوني للخصومات المرورية:

وفقًا لقوانين المرور في الإمارات، تُعتبر النقاط المرورية إحدى الوسائل القانونية لتتبع سجل المخالفات المرورية للسائقين. ويتم منح هذه النقاط بناءً على نوع وخطورة المخالفة. وفي حالة تراكم عدد كبير من النقاط المرورية، قد يواجه السائق عقوبات قانونية مثل تعليق رخصة القيادة أو فرض غرامات مالية.

كيف سيغير التعميم رقم 8 لسنة 2024 نظام العمل في محاكم دبي هذا الصيف؟

في إطار حرص محاكم دبي على تعزيز الكفاءة والمرونة في بيئة العمل، وتحقيق التوازن بين احتياجات العمل ورفاهية الموظفين، صدر التعميم رقم 8 لسنة 2024 من مكتب مدير محاكم دبي يوم الجمعة 9 أغسطس 2024، الذي جاء استجابةً للخطاب الوارد من دائرة الموارد البشرية لحكومة دبي بشأن إطلاق التطبيق التجريبي لتعديل ساعات العمل خلال فصل الصيف، وذلك من خلال مبادرة  “صيفنا مرن”.

أولاً: خلفية التعميم وأهدافه

يأتي هذا التعميم كجزء من جهود حكومة دبي لتحسين ظروف العمل وزيادة الإنتاجية خلال أشهر الصيف الحارة. وقد تم اختيار محاكم دبي، من بين عدد من الدوائر الحكومية، للمشاركة في هذه المرحلة التجريبية لتعديل ساعات العمل، التي تهدف إلى اختبار تأثير تقليص عدد أيام العمل الرسمية في الأسبوع على الأداء العام وجودة الحياة للعاملين.

ثانياً: تفاصيل التعميم

وفقاً للمادة (1) من التعميم، تقرر أن تكون مواعيد العمل الرسمية خلال المرحلة التجريبية من يوم الاثنين إلى يوم الخميس، بواقع 8 ساعات عمل يومياً، مع تعليق العمل يوم الجمعة. هذا التغيير يعني تقليص عدد أيام العمل الأسبوعية من خمسة إلى أربعة أيام، ما يوفر للموظفين فرصة لقضاء عطلة نهاية أسبوع أطول، مما قد يسهم في تحسين التوازن بين الحياة العملية والشخصية.

أما المادة (2) من التعميم، فقد نصت على أن يتم تنفيذ هذا القرار اعتباراً من 12 أغسطس 2024 وحتى 30 سبتمبر 2024، مع ضرورة متابعة الجهات المعنية لتنفيذ هذا التعديل خلال الفترة المحددة.

ثالثاً: الآثار القانونية والإدارية لتطبيق التعميم

The Importance of the New Regulation

This regulation responds to the need to regulate the use of AI systems in a way that enhances public trust and protects fundamental rights. While AI offers numerous economic and social benefits, it also poses significant risks that require careful regulation.

The new regulation imposes strict requirements on developers and users of AI systems, including:

Operators must ensure user data is protected and processed securely and responsibly. The law prohibits systems from expanding or creating facial recognition databases captured randomly from the internet or through audio and video recordings. However, the law allows exceptions for security agencies to use biometric identification cameras with judicial authorization to prevent terrorist threats.

Support for Innovation

The regulation fosters innovation by encouraging small and medium-sized enterprises (SMEs) to develop and use AI technologies. It provides a framework that promotes investment in new technologies without compromising safety and fundamental rights. Under the law, content created using AI, such as texts, images, or videos, must be labeled to protect viewers from misleading content like deepfakes.

مقدمة

تؤكد اللائحة على أهمية حماية البيانات الشخصية، بما يتماشى مع اللوائح العامة لحماية البيانات في الاتحاد الأوروبي. يجب على المشغلين ضمان أن تكون بيانات المستخدمين محمية وأن يتم معالجتها بطرق آمنة ومسؤولة. يمنع القانون أنظمة توسيع، أو إنشاء، قواعد البيانات الخاصة بالوجوه، والتي تلتقط على نحو عشوائي عبر الإنترنت أو من خلال التسجيلات الصوتية والمرئية. ومع ذلك، يسمح القانون باستثناءات بحيث تستطيع أجهزة الأمن استخدام كاميرات تحديد الهوية البيومترية بإذن قضائي دائمًا للحيلولة دون وقوع تهديد إرهابي.

 العقوبات والمراقبة

يتعين على الأنظمة ذات المخاطر المرتفعة الحصول على شهادة من الهيئات المعتمدة قبل طرحها في أسواق الاتحاد الأوروبي. يتولى “مكتب الذكاء الاصطناعي” الجديد الإشراف على تنفيذ ذلك على مستوى التكتل. عدم الامتثال للقانون يؤدي إلى فرض غرامات تصل إلى 35 مليون يورو (38 مليون دولار) أو 7% من العائدات السنوية للشركة المعنية، استنادًا إلى نوعية المخالفة.

تحليل قانوني حول التعديلات الجديدة في قانون تنظيم علاقات العمل في الإمارات

في خطوة تعكس نظرة دولة الإمارات العربية المتحدة بتطوير بيئة العمل وتحقيق التوازن بين حقوق العمال وأصحاب العمل،

صدر في 13 سبتمبر 2023 مرسوم بقانون اتحادي رقم (20) لسنة 2023 بتعديل المادة رقم 54 فقط من أحكام المرسوم بقانون اتحادي رقم (33) لسنة 2021 بشأن تنظيم علاقات العمل في دولة الإمارات العربية المتحدة. يهدف هذا التعديل إلى تعزيز الإطار القانوني لعلاقات العمل وضمان حقوق العمال وأصحاب العمل على حد سواء.

النقاط الرئيسية للتعديلات 

تتضمن التعديلات الجديدة عدة نقاط رئيسية، منها:

1.  إجراءات تسوية المنازعات العمالية 

      – إلزام أصحاب العمل أو العمال أو أي مستحق بتقديم طلبات الحقوق إلى وزارة الموارد البشرية والتوطين، والتي تقوم بدورها باتخاذ الإجراءات اللازمة لتسوية النزاع وديًا.

      – تتيح الوزارة الفصل في المنازعات بقرارات نهائية في الحالتين التلايتين:

الحالة الاولى: إذا  كانت قيمة المطالبة لا تتجاوز 50,000 درهم.

الحالة الثانية : إذا تم التوصل الى تسوية ولم يلتزم احد الاطراف بتلك التسوية (بغض النظر عن قيمة المطالبة)

      – قرار الوزارة بالفصل في المنازعات يكون نهائيًا وملزمًا ويمكن تنفيذه مباشرةً.

2.  إجراءات الاستئناف 

   – يُسمح لأي طرف غير راضٍ عن قرار الوزارة بالتقدم بدعوى أمام محكمة الاستئناف خلال 15 يوم عمل من تاريخ إخطار القرار.ويترتب على على هذا الاستئناف ايقاف ملف التنفيذ (إن كان قد تم فتحه)

3.  حقوق العمال أثناء النزاع 

   – يجوز للوزارة إلزام صاحب العمل باستمرار دفع أجر العامل لمدة لا تزيد عن شهرين في حال توقف صرف الأجر بسبب النزاع.

4.  إجراءات المحكمة 

   – تلتزم المحكمة بتحديد جلسة للنظر في الدعوى خلال 3 أيام عمل والفصل فيها خلال 15 يوم عمل من تاريخ إقامة الدعوى.

5.  تقادم الحقوق 

   – لا تُسمع الدعوى عن أي حق من حقوق العمال بعد مرور سنة من تاريخ استحقاق الحق محل المطالبة.
